IMD Fastrax Terms and Conditions for Charges and Payment

In these Terms and Conditions IMD Media Ltd is referred to as IMD Fastrax, and you, the record label are referred to as the Supplier. By requesting IMD Fastrax to distribute copy through the IMD System (IMD’s proprietary digital distribution and content processing system) the Supplier agrees to be bound by these Terms and Conditions.

Definitions:

Broadcaster

means television broadcaster, website operator, wireless platform operator or any other entity capable of broadcasting and/or making copy available to the public by wire or wireless means.

Music Videos/Audio

means the audio-visual content supplied by the Supplier to IMD under these Terms and Conditions for distribution via the IMD System to Broadcaster

Instructions

means the distribution information to accompany all content which should be submitted to IMD Fastrax, as outlined on the website.

Required formats

means the technical format(s) suitable for transmission via the IMD System and use by the relevant Broadcasters.

1.1 IMD Fastrax will charge for and the Supplier agrees to pay for the distribution of Music Videos on the bases of the fees set out in IMD Fastrax’s current rate unless otherwise agreed in writing by IMD Fastrax. IMD Fastrax may issue a new rate card at any time and the distribution charges which appear on any new rate card will apply to any Music Video distributed on behalf of the Supplier as from the date stated on the new rate card unless otherwise agreed in writing by IMD Fastrax. Fastrax provides review and broadcast services. Each service is charged separately and pricing is stated in the attached Rate Card.

1.2 IMD Fastrax will invoice the Supplier in respect of the distribution of Music Videos promptly after distribution. It is an essential condition of these Terms and Condition that all Review Jobs invoices are paid in advance of the service (together with VAT thereon) And Broadcast Jobs are paid within 30 days of the date of the invoice. By clicking “Please Send” in the Fastrax “Broadcast Video Request” email you are accepting the charge of a broadcast copy to the specified station in their preferred format.

1.3 Any changes to Instructions received by IMD Fastrax after distribution of any Music Video to which they relate will be ignored for the purpose of charging and IMD will be entitled to charge for distribution actually carried out in accordance with supplier’s original Instructions even if a Music Video is not broadcast by any Broadcaster because of the later amendments to the Instructions.

1.4 No charge will be made for any distribution made in error or where distribution is not made or for late distribution except where such non- or late distribution is due to the fact the Music Video/Audio Track was not delivered in the Required Formats on time and/ or its Instructions were not duly delivered to IMD Fastrax on time.

1.5 In the event that any payment due to IMD Fastrax form the Supplier is more than 14 days overdue IMD Fastrax shall, without further notice and without prejudice to any of IMD Fastrax’s other remedies, be entitled to be paid interest of the sums outstanding from the date payment was originally due at a rate of 4% per annum above LIBOR for the period such sums remain unpaid, and in addition IMD Fastrax shall be entitled to be reimbursed for any reasonable costs that may be incurred by IMD Fastrax in recovering such sums.

Rate Card

Option 1 - Silver Package - £150 + VAT

This package includes deliveries to 4 review destinations. If requested by the destination and approved then the broadcast deliveries are also included in the package cost.

Human QC is not included in this package.

Option 2 - Gold Package - £250 + VAT

This package includes deliveries to 8 review destinations. If requested by the destination and approved then the broadcast deliveries are also included in the package cost.

Human QC is included in this package.

Option 3 - Platinum Package - £350 + VAT

This package includes deliveries to all review destinations. If requested by the destination and approved then the broadcast deliveries are also included in the package cost.

Human QC is included in this package.

 

Direct broadcast sends to any destination that doesn’t use our review service will cost £65 + VAT.

Content request from our archive to be delivered direct for broadcast will cost £65 + VAT.
